terms & conditions

1. You are based in England and Wales and you are over 18 years of age.

2. The terms and conditions apply when you have instructed us to start your transaction. You are deemed to have instructed us when you complete the online instruction form and agree to the terms and conditions or instruct us by telephone and verbally agree to the terms and conditions. Our chargeable work starts from the moment that you instruct us.

3. Joslin Rhodes (we/us) offer to undertake the client(s) (you/your) standard conveyancing transaction in conjunction with our solicitor/licensed conveyancer partners for the price quoted in writing to you. If you instruct us for multiple transactions i.e. a purchase and a sale then these are treated as individual transactions.

4. You will be sent a written copy of the quote based on your transaction criteria once you have instructed us. This will be sent by mail to your correspondence address and also by email if you have provided one. This written quote forms the basis of the price agreed for your standard conveyancing transaction.

5. Our estimate of charges includes all standard non-optional charges and searches that would normally apply to a standard conveyancing transaction. There may be other searches that are required, either in relation to our own due diligence or by insistence of your mortgage lender or other third party. Examples of these are mining or environmental searches which costs approximately £25 or bank TT fees that cost approximately £30, where the nature of the chain means that a same day transfer of funds is required in order to meet the agreed timescales. If any other services or searches are required in order to complete your transaction then you will be informed accordingly.

6. The individual solicitor/licensed conveyancer will also send you a terms of business letter and a copy of the quotation when you instruct us.

7. The service provided relates to standard conveyancing work and does not include extras that would not normally be expected within a standard transaction. Examples of which could be, but are not limited to, defective title deeds, lost title deeds, unregistered land and/or property or missing/defective planning permission and/or building regulations. In the event that your transaction requires extra work over and above the standard conveyancing transaction then you will be informed of the situation and provided with an estimate of the costs involved. We will seek your permission before undertaking any extra work.

8. We make no additional charges for professional Indemnity Insurance, dealing with your mortgage lender, or any fax or photocopying fees. Postage is also included although we retain the right to charge for this if your correspondence address is outside the UK.

9. When you are purchasing a property the Inland Revenue requires you to complete a tax form to assess any potential tax liability. As an additional service you may ask us to complete this for you at a cost of £50 + vat.

10. If you have chosen the no completion no fee insurance (NCNFI) then you will not be charged any legal fees for transactions that do not go to completion for any reason. It does not indemnify you against any disbursements that may have been paid out on your behalf or extra work that has been undertaken with your permission. The premium for the NCNFI must have been paid in full prior to the case not proceeding in order for cover to active. The NCNFI cannot be paid retrospectively.

11. If your transaction does not complete for any reason, and you have not taken and paid for the NCNFI then you will be charged our legal fees on a pro rata basis for any work that has already been undertaken. The minimum charge for a case that does not proceed or is cancelled after you have instructed us is £50 + vat per transaction.

12. We reserve the right to recover any monies due to us from any unused funds that you provided for disbursements. The balance will be returned to you.

13. Disbursement costs that we list are based on the information available at the time, however the various bodies do change their prices on a regular basis. We have no control over the prices charged by these bodies and although we do not add any charges above the base cost we cannot guarantee that they will not change. In the event that they change upwards after you have provided us with payment for searches then we will add the difference to your final invoice.
